En cumplimiento del Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016, relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos (“RGPD”) y de la Ley Orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales (“LOPDGDD”), a continuación, Onalabs Inno-hub, S.L. (en adelante “Onalabs”) desarrollador y responsable de la aplicación OnaVital+ proporciona al usuario información sobre el tratamiento de sus datos personales llevados a cabo en esta aplicación (en adelante, la “OnaVital”).

- ¿Con qué finalidad y base legal tratamos los datos personales?
Si es usted usuario de OnaVital, debe saber que Onalabs puede tratar sus datos en base a las siguientes finalidades y bases legales:
| Instalación de OnaVital |
Para la correcta instalación y funcionamiento de OnaVital en el dispositivo del usuario es necesario conocer y tratar cierta información técnica, como el sistema operativo instalado, o el espacio de memoria disponible. Base legal: el tratamiento de datos personales del usuario se llevará a cabo en base al interés legítimo. |
| Registro y gestión del usuario en OnaVital |
Para que el usuario acceda a OnaVital, es preciso que el usuario facilite cuántos datos son requeridos para el registro del usuario. Una vez creado el perfil del usuario se utilizarán los datos para la gestión del mismo los que implica que puedan añadirse modificarse o eliminarse datos del perfil.
Base de legal: el tratamiento para la gestión de la inscripción del usuario se llevará a cabo para la ejecución de un contrato en el que usuario es parte (artículo 6.1.c) del RGPD). |
| Datos de la pulsera OnaVital |
En caso de que el usuario vincule una pulsera Ona Vital a su usuario, se monitorizarán signos vitales como son: pulso, saturación de oxígeno, presión arterial sistólica, presión arterial diastólica i temperatura cutánea. La información se recoge mediante la pulsera vinculada a OnaVital que enviará la información al usuario y la mostrará a través de OnaVital. Este tratamiento incluye el tratamiento de datos fisiológicos y de salud. OnaVital es una solución que busca monitorizar en tiempo real y de manera no invasiva los principales parámetros físicos para el cuidado de la salud de sus usuarios, y permite detectar anomalías en los datos que monitoriza y alertar cuando se alcanzan valores que se sitúan fuera de los rangos determinados como normales para una persona estándar. Base legal: El tratamiento de los datos incluidos los fisiológicos y de salud de los usuarios se llevará a cabo en base al consentimiento explícito necesario para el registro en Onalabs. | Gestión de consultas |
Si contacta con Onalabs para plantear una consulta o presentar una reclamación, sus datos personales se utilizarán para dar respuesta y gestionar, si es el caso, la consulta o reclamación. Base legal: todo tratamiento de datos personales relativo a una consulta o reclamación se llevará a cabo en base al consentimiento del usuario otorgado al haber formulado la consulta, queja o reclamación, o en base a la ejecución de un contrato, en caso de estar relacionado con el servicio recibido. |

Siempre que se cuente con una base legal que lo permita, sus datos se utilizarán para enviarle información sobre Onalabs y comunicaciones comerciales propias informándole de novedades o eventos organizados por nosotros y que puedan ser de su interés. - ¿Por cuánto tiempo conservaremos los datos personales?
Los datos personales serán tratados durante el periodo de tiempo necesario para cumplir con las finalidades descritas en la presente Política de Privacidad y con las obligaciones impuestas por las leyes aplicables, los plazos legales de prescripción, y para la formulación, ejercicio o defensa de reclamaciones, en cuyo caso, los datos personales se encontrarán debidamente bloqueados.
Los datos de salud recopilados por la pulsera y que se muestran en OnaVital se eliminarán una vez se dé de baja el perfil de usuario vinculado a la pulsera.
- ¿A qué destinatarios se pueden comunicar sus datos?
Sin perjuicio de que sus datos personales deban ser comunicados bajo obligación legal a autoridades competentes, Onalabs comunicará sus datos personales a terceros que tratan sus datos personales en calidad de encargados del tratamiento.
OnaVital permite que los usuarios que tienen vinculada una pulsera OnaVital a su perfil, de forma proactiva, autorice a otros usuarios para que accedan a los datos de monitorización de signos vitales. Esta función está tiene como finalidad que, cuidadores o profesionales sanitarios puedan hacer un seguimiento de los datos de salud del usuario con pulsera vinculada y es este usuario el único responsable de autorizar o denegar estos accesos. Onalabs no es responsable del tratamiento de datos que los usuarios autorizados puedan realizar.
- ¿Cuáles son sus derechos?
- Derecho a solicitar el acceso a los datos personales: puedes preguntar si estamos tratando tus datos, y en caso afirmativo acceder a los mismos.
- Derecho a solicitar la rectificación si los datos son inexactos, o completar los datos que tengamos incompletos.
- Derecho a solicitar la supresión de tus datos.
- Derecho a solicitar la limitación de su tratamiento: en este caso, únicamente conservaremos tu información para el ejercicio o la defensa de reclamaciones.
- Derecho a oponerse al tratamiento: dejaremos de tratar los datos personales, con la excepción que deban seguir tratándose por motivos legítimos o para el ejercicio o defensa de posibles reclamaciones.
- Derecho a la portabilidad de los datos: en caso de que quieras que tus datos sean tratados por otro responsable del tratamiento, facilitaremos el trasvase de tus datos al nuevo responsable, siempre que sea técnicamente posible.
- Derecho a no ser objeto de una decisión basada únicamente en el tratamiento automatizado de tus datos personales.
Onalabs trata datos en base al consentimiento, debe saber que el afectado puede retirar el consentimiento en cualquier momento, sin que la retirada del consentimiento afecte a la licitud del tratamiento llevado a cabo previo a la retirada.
Para ejercer sus derechos puedes contactar con Onalabs a través de legal@onalabs.com o por escrito a la dirección postal indicada en el punto 1 de la presente política de privacidad. Asimismo, el usuario podrá presentar una reclamación siempre que lo considere oportuno ante la autoridad competente, en este caso, la Agencia Española de Protección de Datos (https://www.aepd.es), en especial, cuando no haya encontrado satisfacción de sus derechos ante Onalabs.

If you are a user of OnaVital, you should know that Onalabs may process your data based on the following purposes and legal bases:

| User registration and management in OnaVital |

| Facts about the OnaVital bracelet |
In the event that the user links an Ona Vital bracelet to its user, vital signs such as: pulse, oxygen saturation, systolic blood pressure, diastolic blood pressure and skin temperature will be monitored. The information is collected through the wristband linked to OnaVital that will send the information to the user and display it through OnaVital. This processing includes the processing of physiological and health data. OnaVital is a solution that seeks to monitor in real time and in a non-invasive way the main physical parameters for the health care of its users, and allows detecting anomalies in the data it monitors and alerting when values are reached that are outside the ranges determined as normal for a standard person. | Query management |
If you contact Onalabs to raise a query or file a complaint, your personal data will be used to respond to and manage, if applicable, the query or complaint. Legal basis: any processing of personal data related to a query or claim will be carried out on the basis of the user’s consent given when the query, complaint or claim was made, or on the basis of the execution of a contract, if it is related to the service received. |

- How long will we keep personal data?
Personal data will be processed for the period of time necessary to comply with the purposes described in this Privacy Policy and with the obligations imposed by the applicable laws, the legal limitation periods, and for the formulation, exercise or defense of claims, in which case, the personal data will be duly blocked.
The health data collected by the bracelet and displayed in OnaVital will be deleted once the user profile linked to the bracelet is cancelled.
- To which recipients can your data be disclosed?
Without prejudice to the fact that your personal data must be communicated under legal obligation to competent authorities, Onalabs will communicate your personal data to third parties who process your personal data in their capacity as data processors.
OnaVital allows users who have an OnaVital wristband linked to their profile to proactively authorize other users to access vital signs monitoring data. The purpose of this feature is for caregivers or healthcare professionals to be able to track the health data of the user with a linked wristband and it is this user who is solely responsible for authorizing or denying this access. Onalabs is not responsible for the processing of data that may be carried out by authorized users.
- What are your rights?
- Right to request access to personal data: you can ask if we are processing your data, and if so, access it.
- The right to request rectification if the data is inaccurate, or to complete the data that we have incomplete.
- Right to request the deletion of your data.
- Right to request the restriction of its processing: in this case, we will only keep your information for the exercise or defence of claims.
- Right to object to processing: we will no longer process personal data, with the exception that it must continue to be processed for legitimate reasons or for the exercise or defence of possible claims.
- Right to data portability: in the event that you want your data to be processed by another data controller, we will facilitate the transfer of your data to the new controller, whenever technically possible.
- The right not to be subject to a decision based solely on the automated processing of your personal data.
Onalabs processes data on the basis of consent, you should be aware that the affected party may withdraw consent at any time, without the withdrawal of consent affecting the lawfulness of the processing carried out prior to the withdrawal.
To exercise your rights, you can contact Onalabs by legal@onalabs.com or in writing to the postal address indicated in point 1 of this privacy policy. Likewise, the user may file a complaint whenever he/she deems it appropriate with the competent authority, in this case, the Spanish Data Protection Agency (https://www.aepd.es), especially when he/she has not found satisfaction of his/her rights before Onalabs.
